We at Tokyo Capital Management recognize that personal information of our customers, business partners, and employees are important assets which require proper management and protection. The following Privacy Policy of the Nippon Kanzai Group explains our protection of personal information during times when we use or hold this information.

We comply with applicable laws, regulations, guidelines and other standards set out by the government concerning the protection of personal information when using our customers’ and employees’ information in our business activities.

Acquisition, Use and Provision of Personal Information

We will clearly define the purpose for obtaining and using personal information, and take appropriate measures in order to ensure that the information will not be used for a purpose other than the intended use. Furthermore, we will not provide personal information to third parties unless the person to whom the information belongs agrees or when it is required by related laws or regulations.

Complaints and Consultation

In the case that we receive a complaint or a consultation concerning the handling of personal information, we will immediately investigate on the inquiry and respond within a reasonable period of time in a sincere manner.

Security Management

We will take necessary organized, personnel, physical and technical steps to ensure secure management of personal information collected through our business activities to prevent and correct leaks, loss or damage of information.

Continuous Improvement

We will strive to enhance internal systems to protect personal information, and establish a management system for protecting information.

3. Proper Acquisition of Personal Information

We will acquire personal information of clients through proper methods in compliance with the law.

4. Purpose of Using Personal Information

We will only acquire and use personal information of the customers within a scope required to achieve the following purposes. When using personal information for purposes other than intended, we will notify the customer in advance and only use the information upon receiving permission.

  1. Use of Information for Businesses in Compliance with Relate Laws and Regulations
    • Financial Instruments Business, Real Estate Investment Advisory Business, Specified Joint Real Estate Venture Business
      Financial Instruments and Exchange Act, conducting operations such as exercise of rights of customers as well as obligations of customers such as funding based on real estate investment advisory business registration regulations, Act on Specified Joint Real Estate Ventures, and other related laws and regulations, creating reports and other materials, acquisition of assets, sales, renting and leasing, researching related to the aforementioned, and fulfilling contracts related to transactions.
    • Real Estate Brokerage Business, Real Estate Management Business, Management and Operation of Parking
      Mediation (sales, purchase, renting, and leasing) of real estate management, management of real estate (land, buildings, etc.), management of facilities, marketing activities (visits, sending direct mails, solicitation calls, e-mail solicitations) related to management and operation of parking, credit investigation, and fulfilling contracts related to transactions based on the Real Estate Brokerage Act.
    • Construction Business
      Submitting various papers based on laws and regulation upon receiving orders for design, supervision and construction consulting as well as creating reports.
  2. For general work listed above as well as other related operations.
  3. For conducting survey analysis, material gathering, and various guidance required to conduct operations listed above.
  4. For verifying the identification of the person indicated on the application form, contract, etc. required to conduct the operations listed above.
    For verifying identification, creating verification records, and checking for possible association with anti-social forces, etc. based on Act on Prevention of Transfer of Criminal Proceeds.
  5. For providing required personal information to a third party for the purpose of achieving the purpose of above 1 to 4.
    Provision of information to a third party will be suspended upon request from the customer.

5. Provision of Personal Information to a Third Party

We will not disclose or provide personal information of the customer to a third party without receiving prior permission, excluding when required by the law.

  1. When required by the law.
  2. When disclosure of personal information is required to protect human lives, physical safety and asset, and it is difficult to obtain permission from the customer.
  3. When disclosure of personal information is required to improve public health, promote sound nurturing of children, and it is difficult to obtain permission from the customer.。
  4. When we are required to cooperate to those entrusted by national agency or local public organization to pursue operations as stipulated by the law, and obtaining permission from the customer may interfere with the said operation.
  5. Cases accepted by other laws and guidelines related to personal information protection to disclose or provide personal information.

6. Management of Personal Information

  1. We strive to maintain personal information accurately and up to date.
  2. To ensure accuracy and safety of personal information, we take proper measures such as e prevention of unauthorized access to our offices, control access to personal information, limitation of methods to take out personal information, and prevention of unauthorized access from the outside, etc.
  3. We conduct rational safety (security), corrective, preventative measures against loss, destruction, falsification, and leak of personal information from technical and organizational approach.
  4. We conduct strict survey and necessary supervision to ensure safety management of personal information by joint user and external entity when sharing or providing personal information to joint user or external entity.

We may share the use of personal information in the following cases.

  • Personal information that are shared

    Name, address, date of birth, phone number, e-mail address, items related to managing transactions (excluding My Number)

  • Scope of Joint User

    Nippon Kanzai Holdings Co., Ltd.(our sole parent company)

  • Purpose of Use

    For identifying and managing various risk required for the management of Group company.

8. Revision to Handling Personal Information

We will periodically review the Privacy Policy to continuously improve protection of personal information.

10. Procedure for Requesting Disclosure of Personal Information

We respect the individual rights to their personal information and promptly respond in a rational manner regarding customer’s request for notification of the purpose of use, disclosure, correction (correction, addition, deletion), suspension of use, etc. (suspension, deletion) as well as suspending provision of personal information to a third party if customer is identified as his/herself and no objection is received from the customer about our methods.
